The court of Appeal sitting in Akure, Ondo State capital has set aside the judgement of the Ondo State high court that sentence the founder of the Sotitobire praising chapel. The Ondo State high court had sentence the prophet to life imprisonment over the disappearance of one- year- old ‘ Gold Kolawole’ in his church in 2019.
The Shotitobire founder had ask the Appeal court to nullify his life sentence conviction by the court. The Appeal court ruled that the circumstantial evidence that the high court based it judgment is not enough to convict him, thus, he was therefore discharged and acquitted.
Justice Barka faulted the prayers of the counsel to the appellant, Gboyega Awomolo (SAN), who was represented by Akinyemi Omoware that Department of State Services (DSS) cannot investigate crime.
Awomolo added that the DSS should not have arrested or investigated the case since it was a criminal matter, thus nullifying other actions including the prosecution and eventual conviction of the Prophet.
The new outcome of this case is indeed a miraculous one. This is because the case suffered a number of setbacks following attempts by the police to muddle it up. Also, the Akure community out of anger had reacted violently by burning the prophet’ s church located at Oshinle, in Akure, the Ondo State capital.
The Parents of the child accused the prophet of masterminding the kidnap of the child in November 2019, having made an attempt to frustrate searches during the incident.
As if that was not enough, some members of the Shotitobire church were also accused of having a hand in the kidnap of the child. The names of these church members are: Omodara Olayinka, Margaret Oyebola, Grace Ogunjobi, Motunrayo Egunjobi, Esther Kayode, and Peter Anjorin.
